Contracts are made and orders accepted only upon and subject to these terms and conditions.

We are committed to providing the best possible service to old and new customers alike. If you feel that there is anything we could do better, or anything you would like to know more about, please contact us.

Disclaimer

The company reserves the right to change, add or delete any part of these terms and conditions. The terms and conditions that are in force at the time the contract between the company and the buyer is entered into, shall be those that apply.

Although we strive to make the company’s website as comprehensive and accurate as possible, we cannot guarantee it is error free.

Whilst we aim to provide correct information, all photographs, measurements, specifications or descriptions submitted or contained on the website are approximate only, and can not be deemed to form part of the contract or be treated as consisting any warranty, representation or condition in relation to the goods. Product weights quoted on the website are taken from product packaging. The company is not responsible for any mistakes made by the manufacturer. Product pictures are an indication only, packaging may vary.

The company cannot guarantee uninterrupted access to our website.

The company cannot take responsibility for the content of other websites we provide links to. We have no control over their security and privacy policies, which may be different from our own.

Registering

To make a purchase just browse our shop, adding any items you wish to buy to the shopping basket using the "Purchase" button. After you have finished shopping, click on "Checkout" and you will be asked to complete a registration form, which asks a few relevant details that we need to complete the order. The information you provide us with on our website may be used to improve our services, as well as to communicate with you regarding orders, offers and additional company information. However, your information will not be passed on to any other parties.

The company reserve the right to block users or terminate accounts.

Ordering

The company cannot bear liability for the unavailability of any items.

Any order for goods by the buyer to the company shall be deemed an offer by the buyer to purchase. It is the buyer’s responsibility to ensure that they provide correct and appropriate details at the time of placing the order – including correct delivery address, delivery notes and contact details.

After placing and paying for your order you will receive a confirmation of order. This confirms that we have received your order, it does not indicate that a contract exists between us. If you do not receive a confirmation please place your order again. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice.

On the date on which the buyer places the order authority for payment will be requested from the buyer’s card issuer. Authority for payment must be given at the time of order and in the event that it is not, the company reserves the right to refuse the order without liability. 

Gift Messages

The company reserves the right to reject any message that we consider might offend the recipient for defamatory, racist, offensive, abusive, indecent, obscene, menacing or in breach of confidence, copyright or any other legal rights.

Security

When the order is placed on our website, credit card numbers are encrypted using 128 bit encryption. They are not held in clear text on any website. The company does not see your number or store it anywhere. The money transaction is handled by our secure payments provider. Your details are not passed on to any third party.

Once you have registered you are responsible for any orders made under your account name. For this reason we advise you not to reveal your password to others. If there has been legitimate fraudulent use of your card this no longer applies. Please inform us immediately if you believe someone else is using your account.

Price

We aim to offer fair and competitive pricing to reflect the value of the goods.

Unless otherwise agreed in writing by the company, the price for goods will be the price set out on the website at the time the buyer’s order is accepted.

All products shown on the website include VAT where appropriate. Delivery charges are not included. These charges are clearly shown in the FAQs section of the website, or throughout the shop area.

While we try to ensure that all of the prices on the website are accurate, we are dependent on technology and system errors may sometimes occur. If we discover an error in the price of goods ordered we will inform the buyer as soon as possible. We will then give the buyer the option of reconfirming the order at the correct price or cancelling it.

Delivery and Title

Parcels will need to be signed for unless you specify in the delivery notes that you are happy for it to be left somewhere. If this is the case, please be careful to choose somewhere as secure as possible. Risk of damage to or loss of the goods passes to the buyer at the time of delivery; at this point the buyer assumes responsibility regardless of whether they are present to accept the delivery or not. We are unable to compensate for theft or damage to a parcel delivered in this manner.

We can only sell alcohol to persons over 18 years of age. Once alcohol has been delivered to your home, you must take responsibility for it.

The company reserves the right to refuse an order and to change the delivery options.

Amendments and Cancellations

The buyer is entitled to amend their order at any time providing the goods have not already been packed, by calling us on TEL. or sending an email marked ‘URGENT’ to website@joshuasharveststore.co.uk.

Please bear in mind that orders placed before 9.30am are packed by midday the same day unless you specify otherwise, and orders placed after 9.30am are packed by midday on the next working day.  If you have specified a delivery date you are able to cancel your order up until midday the day before expected delivery.

Under the Distance Selling Directive, you may cancel your order within 7 working days of delivery. However, this does not apply to food and beverage products. If you are unhappy with any non-food products that you receive, please contact us within this 7 day period and we will treat the circumstance in accordance to our returns policy.

Returns Policy

Your rights to return goods are protected under the "EU Distance Selling Directive" which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm

In the event that goods are delivered incorrect, incomplete or damaged, the buyer must notify the company within 2 days of delivery. The company will then arrange with the buyer for the return of the goods to the company. We are unable to offer refunds or replacements for goods returned to the company without prior communication. The company will, at its own discretion, offer a replacement, refund the goods, or offer a credit for future online purchases where appropriate. The company will only replace or refund goods if they have been returned within 5 days of the buyer notifying the company of the fault, and if the goods are appropriately identified and packaged. Returned goods should be addressed to the ‘Returns Department’, Joshua’s Harvest Store, Gosford Road, Ottery St Mary, Devon, EX11 1NU. Please obtain proof of postage for anything you return to the company.

Privacy

The privacy of our website members and the security of their details is important to us. We ensure that any information collected when using the website will never be given, traded, sold, released or otherwise communicated in any form to any third party.

For security purposes any information you submit to this website will be stored by us for the minimum legal period for your saftey and the saftey of other users of this website.Cookies are used on this shopping site to keep track of the contents of your shopping basket and to store delivery address, etc. However, your credit card details are not seen or stored by us at any point. Cookies are also used after you have logged on as part of the process. You can turn off cookies within your browser by going to "Tools - Internet options - Privacy" and selecting to block cookies. If you turn off cookies you will be unable to place orders or benefit from other features that use cookies.

Force Majeure

The company shall not be liable if it is prevented from or delayed in the carrying out of its obligations under the Contract by situations of force majeure including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to either party's workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials or any other event beyond the reasonable control of the company.
